This Agreement contains the terms and conditions that apply to the Customer's purchase of hardware, software and/or other products (Item or Items) from Terrestrial Technologies (VoIPPabx.com). By accepting delivery and/or installation of the Item(s) described on the invoice, Customer agrees to be bound by and accepts these terms and conditions. THESE TERMS AND CONDITIONS APPLY (i) UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH TERRESTRIAL TECHNOLOGIES (VoIPPabx.com), IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN; OR (ii) UNLESS OTHER TERRESTRIAL TECHNOLOGIES (VoIPPabx.com) STANDARD TERMS APPLY TO THE TRANSACTION. These terms and conditions are subject to change without prior written notice at any time, in Terrestrial Technologies's (VoIPPabx.com) sole discretion.

Prices and conditions of sale on all in-stock and special order merchandise are subject to change without notice. Every effort has been made to ensure the accuracy of all information contained herein.

Terrestrial Technologies (VoIPPabx.com) makes no warranty expressed or implied with respect to accuracy of the information, including price, product editorials or product specifications. Product and manufacturer names are used only for the purpose of identification only.

The image displayed for every product might not be the exact picture. This is used for display purposes only.

All implied warranties including but not limited to implied warranties or merchantability and fitness for a particular purpose are hereby excluded.

Software Sales Final. All software sales are final. Terrestrial Technologies (VoIPPabx.com) will not refund money or exchange for any software purchased.

Disclaimer of Warranties on All Software. Terrestrial Technologies (VoIPPabx.com) makes no warranties, either express or implied, with respect to all software and accompanying manuals and materials, regardless of their source, their quality, performance, merchantability or fitness for any particular purpose. All such items are sold or licensed to purchaser by Terrestrial Technologies (VoIPPabx.com) on an "as is" basis. The entire risk as to their quality and performance is with the purchaser. Should such software prove defective following their purchase, purchaser assumes the entire cost of all necessary servicing, repair, or correction and any incidental or consequential damages resulting from any defect in such software. In no event will Terrestrial Technologies (VoIPPabx.com) or its suppliers be liable for direct, indirect, incidental or consequential damages resulting from any defect, even if Terrestrial Technologies (VoIPPabx.com) has been advised of the possibility of such damages.

Terrestrial Technologies (VoIPPabx.com), its hardware or its software suppliers, makes no warranty, express or implied, concerning the applicability of any hardware or software to any specific purpose.

Order Cancellation
Order cancellation must be emailed to cancel@voippabx.com within 24 hours of the placement of the order. Cancellations placed after 24 hours or order has shipped may result in a 20% restocking fee.

Claims: All merchandise leave our warehouse in good condition. The risk of loss or damage to goods shall pass to buyer as soon as such goods are picked up by carrier for delivery to buyer. Buyer should therefore inspect all packages for damages before signing delivery receipt. Claims should be filed immediately with the carrier for merchandise damaged in transit.

In the event of a dispute. Terrestrial Technologies (VoIPPabx.com) shall be entitled to recover reasonable attorney(s) fees and cost incurred in the dispute resolution.
